Terms of Use

1. Introduction and Acceptance of Terms

These Terms constitute a legally binding agreement between you and Maps Co (owned and operated by Yenzokuhle Sisekelo Maphalala), operating the WhereUapp platform ("WhereUapp," "we," "us," or "our"). WhereUapp provides a platform for users to search property listings.

2. Definitions

• App/Services: The WhereUapp mobile application, website, and all associated tools and features.
• User: Any individual who accesses or uses the App.
• Property Services: Features related to searching, viewing, or listing real estate properties.
• Content: Text, graphics, images, software, audio, video, works of authorship, and information or other materials posted, generated, provided, or otherwise made available through the Services.

3. Accounts and Registration

A. Age Requirement: You must be at least 18 years of age to create an account and use the Services. By creating an account, you represent and warrant that you are 18 years of age or older.

B. Account Security: You are solely responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify WhereUapp immediately of any unauthorized use of your account.

C. Account Use: Your account is personal to you. You may not authorize third parties to use your account, and you may not assign or otherwise transfer your account to any other person or entity.

4. Platform Services

4.1. Property Services (Listings and Search)

A. Accuracy of Listings: WhereUapp hosts listings provided by third-party real estate agents, owners, or developers. We do not verify the accuracy of all listing information, and we make no guarantees regarding the condition, legality, or suitability of any property listed. Users must conduct their own due diligence before entering into any transaction.

B. Appointments: The App may facilitate scheduling property viewings. These viewings are conducted by the respective listing agent or owner, and WhereUapp is not responsible for their conduct or professionalism.

5. Fees, Payment, and Cancellations

A. Pricing: You will be charged fees for Services based on the rates displayed to you in the App.

B. Payment: All charges are due immediately and will be processed using the designated payment method in your account. If your primary payment method expires or fails, you agree that WhereUapp may charge any secondary payment method in your account.

C. Taxes: You are responsible for any applicable national, state, or local taxes arising from the Services, other than taxes based on WhereUapp's net income.

6. Your Obligations and Code of Conduct

You agree to comply with all applicable laws and use the App only for lawful purposes. You agree not to:

• Harass, threaten, or abuse any other User.
• Use the App to transmit unsolicited commercial messages ("spam").
• Impersonate any person or entity.
• Infringe upon WhereUapp's or any third party's intellectual property rights.
• Carry hazardous materials or illegal items, or conduct illegal activities during use of the Services.

F. Consequences of Violation: Failure to comply with the obligations in this Section 6, the Age Requirement in Section 3.A, or any other provision of these Terms, may result in the immediate and permanent suspension or termination of your account, refusal of Service access, and may subject you to civil or criminal penalties.

7. Intellectual Property

The App, including its design, interface, software, and Content (excluding third-party property listings and User-submitted Content), is the exclusive property of WhereUapp and is protected by copyright, trademark, and other laws. Your use of the App grants you no ownership rights to any Content.

8. Disclaimers and Limitation of Liability

A. Disclaimer of Warranties: The Services are provided "as is" and "as available." WhereUapp explicitly disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

B. Limitation of Liability (General): WhereUapp shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the Services, even if WhereUapp has been advised of the possibility of such damages.

9. Termination

We may terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, immediately and without notice, if you breach any of these Terms. We may also terminate or suspend your account for any reason or no reason at all. You may cease using the Services at any time.

10. General Provisions

A. Governing Law: These Terms are governed by and construed in accordance with the laws of Eswatini, without giving effect to any conflict of law principles.

B. Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

C. Modification: WhereUapp reserves the right to modify these Terms at any time. We will notify you of material changes either through the App or by email. Continued use of the App after any modification constitutes your acceptance of the modified terms.
